Am I eligible to make a claim?

If you have been injured in an accident that has been directly or indirectly caused by another person or organisation, such as the council, then you are eligible to claim against them for any undue expenses that you have incurred, for the damage to your bike, compensation for your injuries and any treatment required.

How does no-win no fee work? Will I have to pay anything?

No win no fee is a phrase you have probably heard a lot, and these days it often seems to have quite a negative sentiment attached to it. Actually, “No win No fee” is just the common term for a “conditional fee agreement”, which simply means that if your case is not successful, and providing you have cooperated fully with your legal team, you will not have to pay a penny. At Bike Legal, we never ask for any payments upfront or during your case and strive to ensure that people are not put off pursuing justice or losses because of a fear of legal costs.

What can I make a claim for?

There are many different costs that can be included in your claim. You can claim for the damage to your bike or the cost of a like-for- like replacement if required, and any cycling equipment that may have been damaged can be replaced. You may also be eligible to claim for any loss of income, which you have sustained, and any other out of pocket expenses you have suffered. If you were injured, then you are entitled to compensation, which also includes any medical expenses or physio treatment costs.

I don't have the other drivers full details?

It is often possible for us to trace the other driver and their insurance company from very limited information. Also, the police may be able to assist and we are able to contact them on your behalf if required. If the case was a hit and run, or the driver was not insured, then we may still be able to pursue a case on your behalf through an organisation set up to compensate such victims (the Motor Insurers Bureau). We have a specialist team that deals with these types of case.

I hit a pothole/my case didn't involve another road user?

Sadly, many of the UKs roads have fallen into a state of disrepair. If you come off your bike because of a pothole, then you may be able to claim against the council. We have dealt with many pothole cases over the years, and are fully versed in the legal requirements and standards that councils are duty bound to adhere to. If your case involved mud deposits, ice caused by a spillage, oil, debris, roadworks or any other hazard on the road, we may also be able to pursue a case on your behalf.
